Introduction
The products are sold new and without preservatives. These conditions apply to the exclusion of all other conditions, including those in force in stores. If a condition is missing, it will be considered to be governed by the customs in force in the sales sector. Electrodiscount Store reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will apply to each order.
Article 1 - Order
The customer places his order according to the process in force on the site and confirms the detailed summary of it.
The customer is required to provide all information necessary for delivery: address, access code, floor, etc. (and, for example, in the case of items with special delivery conditions: telephone number at which they can be contacted during the day to make an appointment).
When placing an initial order and/or registering, the customer must enter their first and last name, email address, and password. The password is strictly personal.
During each visit, when accessing personal data or when placing an order, the customer will have been identified in advance by their username and password, it being specified that this is not used to make a payment.
The information recorded by the Electrodiscount Store system is considered as proof of the transactions concluded between Electrodiscount Store and its customers.
The contractual information is presented in French and will be the subject of a confirmation including this contractual information at the latest at the time of delivery.
Electrodiscount Store reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.
Electrodiscount Store acknowledges receipt of the order to the customer by displaying the order reference and sending an email containing this information.
The customer's order will only be considered accepted after its validation by Electrodiscount Store.
Some orders may require additional requests from the customer. In this case, the customer will be notified by email of the supporting documents to be sent in order to obtain final validation of their order.
Electrodiscount Store reserves the right to cancel the order in the event of non-receipt of these supporting documents or receipt of documents deemed non-compliant.
The customer's order may be cancelled by Electrodiscount Store in the event of a lack of information necessary for delivery.
The customer will be informed by Electrodiscount Store.
Article 2 - Price
The prices of our products are indicated in euros, all taxes included, excluding shipping costs.
All orders, regardless of their origin, are payable in euros.
Electrodiscount Store reserves the right to modify its prices at any time, but products will be invoiced based on the prices in effect at the time the order is placed.
These prices are applicable within the framework of distance selling. They cannot, under any circumstances, be the subject of a request for application in store (and vice versa), the conditions of sale, services and guarantees being different and therefore not comparable.
Promotional codes
They are available on the Electrodiscount Store blog, the site's Facebook page, and more generally on all communication media and through Electrodiscount Store's various partners. Their use is subject to certain conditions:
- Promotional codes are only valid for the periods given in the communication materials above and for the products and/or product categories expressly named.
- In order to benefit from the reduction linked to the codes, it is imperative to enter them in the box reserved for this purpose in the basket and before validating it.
- If you forget to enter, Electrodiscount Store will not be able to cancel the order or renew it to take the promotional code into account.
Article 3 - Validation
The customer declares to have read and accepted these general conditions of sale before placing his order.
Validation of the order therefore constitutes acceptance of these General Conditions of Sale.
Article 4 - Availability
Product offers and prices are valid as long as they are visible on the site, while stocks last.
Article 5 - Delivery
Products purchased on Electrodiscount Store are only delivered to mainland France, Europe: Spain, Portugal, United Kingdom... or other countries and Monaco.
Products are delivered to the delivery address indicated during the ordering process.
Electrodiscount Store cannot be held responsible for the consequences due to a delay in delivery or sea crossing by providing proof that the poor execution of the order is not its fault in accordance with article L 221-15 of the Consumer Code.
The shipping or delivery time of the products is explicitly stated in the description sheet of each product.
The mention "shipped within 24, 48 or 72 hours" applies to small household appliances, digital entertainment and games available in stock for which preparation, packaging and delivery to the carrier take place a maximum of 24, 48 or 72 hours after validation of the order.
The "shipped within 7 days" statement applies to large household appliances, bedding and furniture available in stock for which preparation, packaging and delivery to the carrier take place within a maximum of 72 hours after validation of the order.
This period excludes weekends and public holidays, and depends on available quantities.
Delivery generally takes place within 2 to 10 days (excluding weekends and public holidays) after the order has been confirmed, except:
- products from the EXCELLIS Collection range and the PREFERENCE line from the BOSCH / SIEMENS brand noted within 7 days.
- items for which an additional period is expressly stipulated at the time of ordering.
Electrodiscount Store cannot be held responsible for the consequences of any events beyond its control, in particular cases of force majeure or those caused by the carrier, which tend to delay or prevent the delivery of the products ordered, it being up to Electrodiscount Store to provide proof that the poor execution of the order is not its fault in accordance with Article L 221-15 of the Consumer Code.
"Temporary or permanent unavailability of products from our suppliers: In the event of permanent unavailability, we undertake to reimburse you for the missing items, without delay and at the latest within 14 days.
However, you may be offered replacement items of equivalent quality and price.
In the event of temporary unavailability, we will inform you of the date on which the product will be available again. You then have the option of maintaining your order with these new deadlines or canceling it. In the latter case, we undertake to reimburse you for the missing items without delay and at the latest within 14 days.
In the event of non-compliance with the deadline mentioned in the description sheet, the customer can cancel his order by sending an email to customer service.
Cancellation will only be taken into account by Electrodiscount Store if the shipment or delivery has not taken place between the sending and receipt of said email.
The customer will be reimbursed within 14 days of receipt of the email by Electrodiscount Store.
The customer undertakes, for himself or for the recipient of the order, to take delivery of the goods at the address he indicated when ordering.
Upon delivery, the customer or recipient of the products must be able, if requested, to provide proof of identity.
The customer undertakes, after opening and checking the contents of the package(s) in the presence of the carrier, to sign the delivery receipt presented by the delivery person.
By signing the delivery receipt without specific reservations, and accepting the products, the customer acknowledges having received the goods in a condition giving them complete satisfaction.
Therefore, any claim relating to the condition of the delivered products cannot be accepted.
In the event of delivery not conforming to the order in quality or quantity, the customer must inform Electrodiscount Store, indicating the order reference.
Electrodiscount Store will inform the customer in writing at the time of purchase, if applicable, of the cost of delivery and commissioning of the goods. A written notice will be left with the customer upon taking possession of the goods, mentioning the possibility for the consumer to express reservations, in particular in the event of a defect in the goods or failure to provide the operating instructions or installation instructions.
In accordance with Article L 221-15 of the Consumer Code, Electrodiscount Store is fully liable to the customer for the proper performance of the obligations resulting from the sales contract, whether these obligations are performed by Electrodiscount Store or by other service providers, without prejudice to its right of recourse against them.
However, Electrodiscount Store may be exonerated from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
In the event of a problem, the customer will make any reservations corresponding to the observations noted on the delivery sheet, have the delivery person co-sign and keep a copy of the document to send to Electrodiscount Store.
In the event of transport damage, the customer must refuse the damaged product to the delivery person and indicate "Refusal due to damage" on the delivery sheet and send this document to Electrodiscount Store.
In this case, Electrodiscount Store will then be responsible for reshipping the product or refunding it and will take action against the carrier based on the document sent by the customer.
If the customer has accepted the product without reservation, the transfer of ownership has taken place and Electrodiscount Store is then deemed to have fully fulfilled its obligations resulting from the sales contract, except in the event of subsequent enforcement of the legal guarantee.
Article 6 - Payment
Payment for purchases is made by bank cards (Visa, MasterCard, other credit cards), bank transfers, financing, or Paypal.
Article 7 - Satisfied or your money back
The customer has 15 days from receipt of the ordered products to exercise their right of withdrawal, without having to provide reasons or pay penalties. This right cannot be exercised for audio, video or computer software recordings unsealed by the customer. However, return costs remain the responsibility of the customer.
If the customer exercises this right of withdrawal, the return of the products must be made in their original packaging, in new condition for resale, accompanied by all accessories and instructions in perfect condition for resale, with the original invoice to which the products relate and the return number given by the Customer Relations Department.
Any product that is damaged, incomplete, missing, or whose original packaging has been damaged, or without the invoice accompanied by the return number, cannot be exchanged or fully refunded. In such cases, Electrodiscount Store reserves the right to apply compensation for the depreciation of the product.
Electrodiscount Store also reserves the right not to accept the product if the accessories mentioned in the product's technical sheet are missing.
Electrodiscount Store recommends that the customer return their products with additional insurance guaranteeing, where applicable, compensation for the products up to their actual market value in the event of loss or damage to the package(s).
Electrodiscount Store is required to exchange the goods or refund the amounts paid by the customer (price and delivery costs). Return costs, however, remain the responsibility of the consumer.
Reimbursement may be made by re-crediting the bank card, by transfer or by bank check within a period of less than 14 days following the date on which the right of withdrawal was exercised.
Article 8 - Security
The Electrodiscount Store website is protected by a security system using the SSL encryption process.
Secure payment allows for fast order processing while ensuring customer safety.
Thanks to the SSL encryption process, the customer is automatically directed to our banking partner's server. The transaction is carried out in a secure mode, guaranteeing the confidentiality of the information provided. This SSL encryption ensures that the encrypted banking details (credit card number, expiration date, and cryptogram) are never transmitted over the network or even to the Electrodiscount Store website.
From the second transaction with Electrodiscount Store, the customer may be required to complete only their cryptogram code in order to secure and simplify the transaction.
In addition to this secure system, Electrodiscount Store wanted to protect the customer, beyond current legislation, by subscribing at its own expense to additional insurance for remote payments via Oney Trust.

Article 10 - Intellectual property
All texts, comments, works, illustrations and images reproduced on Electrodiscount Store are reserved under copyright and intellectual property law worldwide.
As such and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code.
Any total or partial reproduction of the Electrodiscount store site is strictly prohibited.
Article 11 - Liability
The products offered comply with current French legislation and the standards applicable in France.
Electrodiscount Store cannot be held responsible for the non-performance of the contract concluded in the event of force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flooding, fire, it being up to Electrodiscount Store to provide proof that the poor execution of the order is not its fault in accordance with Article L 221-15 of the Consumer Code.
In the event of professional purchases, Electrodiscount Store will not incur any liability for any indirect damages resulting from these terms, loss of business, loss of profit, loss of opportunity, damages or costs, which may arise from the purchase of the products.
The total or partial impossibility of using the products, in particular due to hardware incompatibility, cannot give rise to any compensation or reimbursement or questioning of the liability of Electrodiscount Store.
Article 12 - Guarantee
1-Provisions relating to the LEGAL GUARANTEE
Independently of the contractual guarantee developed below, Electrodiscount Store remains liable for defects in conformity of the goods to the contract under the conditions provided for in articles L.217-4 et seq. of the consumer code and for hidden defects in the product sold under the conditions provided for in articles 1641 et seq. of the civil code.
It is recalled that within the framework of the legal guarantee of conformity, the consumer:
- has a period of two years from delivery of the goods to take action against the seller;
- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the goods during the 24 months (twenty-four months) following delivery of the goods.
The legal guarantee of conformity applies independently of the commercial guarantee that may cover your goods. It is recalled that the consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
• Art. L.217-4 of the Consumer Code:
"The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging, assembly instructions or installation when this has been made his responsibility by the contract or has been carried out under his responsibility."
• Art. L.217-5 of the Consumer Code:
"The property complies with the contract:
1° If it is suitable for the use usually expected of a similar good and, where applicable:
- if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or if it presents the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted."
• Art. L.217-12 of the Consumer Code:
"The action resulting from the lack of conformity is prescribed after two years from the delivery of the goods."
• Art. L. 217-16 of the Consumer Code:
"When the buyer requests from the seller, during the course of the commercial guarantee granted to him upon the acquisition or repair of a movable good, a restoration covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee which remained to run.
This period runs from the buyer's request for intervention or from the provision for repair of the goods in question, if this provision is subsequent to the request for intervention."
• Art. 1641 of the Civil Code:
"The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have paid a lower price for it, if he had known of them."
• Art. 1648 paragraph 1 of the Civil Code:
"The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect."
2- Provisions relating to the Electrodiscount Store contractual guarantee
This contract guarantees the repair of the device following damage affecting its proper functioning and resulting from a phenomenon of internal origin.
The guarantee is valid throughout mainland France, Europe and the Principality of Monaco.
To benefit from the product warranty, it is essential to keep the purchase invoice. Only the latter is valid as proof of purchase. The warranty begins on the date of receipt of the product. The delivery slip must therefore be kept by the Customer as proof. Otherwise, the warranty will begin on the invoice date of the product. It will end at the end of the duration defined by the manufacturer for the said product.
Under these conditions, Electrodiscount Store Company undertakes:
I) To exchange your device free of charge within 8 days of purchase, if you notice a malfunction and if all of the following conditions are met: - device in perfect condition, clean and without any signs of use;
- in its complete factory packaging;
- accompanied by the warranty card;
- not repairable by us within 24 working hours.
II) To ensure the proper functioning of devices that have suffered an internal breakdown; this guarantee covers:
- replacement of defective parts;
- labor;
III) Exclusion of warranty, ARE NOT COVERED BY THE WARRANTY:
- Damages involving the liability of a third party or resulting from intentional or willful misconduct.
- Damage resulting from the use of energy, employment or use not in accordance with the manufacturer's instructions or negligence.
- Replacement of consumable parts, such as: seals, filters, batteries, accessories and display parts, oven mitts, lamps, spark plugs, overhead projector lamps, etc.
- Replacement or repair of devices resulting from oxidation.
- Antenna failures, connection or commissioning errors.
- Damage resulting from industrial or commercial use.
- Damage resulting from fire, lightning, storm or vandalism.
- Material and immaterial damage resulting from the breakdown of the device (disturbance of use, contents of the devices, etc.).
IV) Replacement: If the device is irreparable, Electrodiscount Store undertakes to compensate you on the basis of the initial value less obsolescence determined at the rate of 1.50% per month from the 181st day following the delivery date (in accordance with Article L 211-7 of the Consumer Code), to be used on a replacement device of the same function, purchased from Electrodiscount Store. This provision may also be offered in the event of repairs for an amount greater than the market value defined according to the preceding terms.
In the same case, Electrodiscount Store may replace the irreparable device with a new device of the same characteristics, charging the price with the obsolescence coefficient provided above.
The customer will then be required to pay the difference between the price of the new device and the value of the old one after applying the obsolescence calculation.
If the price of the replacement device is lower than the price of the replaced device, after deduction of obsolescence, the difference will be the subject of a one-year voucher which will be given to the customer.
In the event of replacement of equipment under the contractual warranty, the new equipment does not benefit from a new contractual warranty but from the warranty period remaining until the expiry of the initial contractual warranty.
V) The duration of availability of functional spare parts is equal to the duration of the contractual guarantees.
3 - Conditions of paid services - Warranty extension
Electrodiscount Store undertakes to offer you, during the sale, the subscription of an extended warranty for certain product families allowing the warranty to be extended up to 5 years depending on the product family.
This extended warranty covers:
- Replacement of parts (see special conditions);
- Labor under the same conditions as the contractual guarantee;
- Travel (see special conditions);
4 - Validity of the warranty extension
I) The application of the warranty extension is subject to the presentation at each intervention of the invoice justifying the subscription and payment of the warranty extension.
II) All repairs must be carried out by the after-sales service of Electrodiscount Store Company, otherwise the warranty will be void.
The warranty extension is not transferable and is not renewable.
5 - Exclusion of the warranty extension
Same as exclusions from the contractual warranty.
6 - Replacement:
Identical to the terms of the contractual guarantee.
Furthermore, in the event of replacement of equipment under the warranty extension, the new equipment does not benefit from a new warranty extension but from the warranty period remaining until the expiry of the initial warranty extension.
7 - Possible disputes
In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of:
- From a consumer association;
- Or a consumer organization;
- Or any other advice of his choice.
It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee nor the duration of the contractual guarantee.
It is recalled that as a general rule and subject to the assessment of the courts, compliance with the provisions of this contract assumes:
- That the buyer honors his financial commitments to the seller;
- That the buyer uses the device in a normal manner;
- That for operations requiring high technicality, no third party not approved by the seller or the manufacturer intervenes to repair the device (except in cases of force majeure or prolonged failure of the seller).
Article 13 - Entirety
In the event that one of the clauses of these conditions is null and void by a change in legislation, regulation or by a court decision, this shall in no way affect the validity and compliance with these general conditions of sale.
Article 14 - Proof
In all cases, the online provision of the bank card number and the final validation of the order will constitute proof of the entirety of said order in accordance with the provisions of the law of March 13, 2000 and will constitute payment of the sums incurred by the selection of the items appearing on the order form.
This validation constitutes a signature and express acceptance of all operations carried out on the site. The computerized records, stored in the darty-storeI.com computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
The archiving of purchase orders, order confirmations and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil Code.
